SCOPE

At 2BLoved (“we”, or “our”, or “us”, or “they”, or “organization”), our goal is to encourage people living and residing in the United States of America (USA) who are wanting to improve their mental wellness. We provide Emotional Support, information, and professional resources. We are not trained nor licensed medical professionals, therapists, psychologists, psychiatrists nor counselors. We cannot diagnose, nor give medical advice or medical care. We are individuals who care about each person we encounter and act as a loving friend, socially advocating for mental wellness. Our aim is to connect the good hearts of people, through Love. If you are in need of professional medical help, you can find a list of professional mental wellness resources and services on our website, 2BLoved.org/FindHelp.

2BLoved will not encourage, endorse, nor support individuals who inflict self-harm or the harm of others. Should we be made aware that someone is in danger, we will direct individuals who contacted us to the appropriate professional resources and will contact Emergency Authorities, notifying them of potential danger.

Our Services are intended to support you in staying safe and healthy. However, please remember that your use of and interacting with 2BLoved does not create or imply an attorney-client relationship, a doctor-patient relationship, a therapist-client relationship, a therapist-patient relationship, or any other sort of confidential relationship. 2BLoved is not a substitute for professional health care, mental health treatment, psychiatric care, or therapy of any kind. If you believe you are experiencing a medical emergency, you should immediately call your doctor or 911. And, if you are experiencing a clinical or long-term issue, you should consult a medical professional.

Please note that 2BLoved is not endorsing any resources we post nor is 2BLoved responsible for the content or service provided by any of those resources. 2BLoved is simply sharing information with the best intentions.

In accessing our social media pages, call-line, text-line, website or app operated by 2BLoved, you agree to these Terms of Service and our Privacy Policy described below.

TERMS AND PRIVACY POLICY

We care about you and we want to be thoughtful about the Terms and how 2BLoved works. So, these Terms may be changed from time to time. Any changes will be effective immediately upon posting them to our website at 2BLoved.org/Terms & Privacy Policy. Continuing to interact with 2BLoved after we’ve changed the Terms will mean that you accept the revised Terms.

Each time that you engage with 2BLoved, by text, email, or on social media; you’ll receive an automated reply with a link to our current Terms so you may review them before continuing to interact with us. Interacting with 2BLoved after receiving the link will mean that you accept the Terms then in effect.

2BLoved will not share any disclosed names, contact information, locations, or personal information of anyone who interacts with us. However, if someone contacts us and shares plans to act on the intent to harm themselves or others, we will share all relevant information with Emergency Authorities.

At times, 2BLoved may ask individuals to share their story or testimonial to be used in content. This permission must be signed off by the quoted individual in order to be used. If 2BLoved shares feedback they have received from an individual, it can only be used as content if no Personally Identifiable Information (“PII”) is contained. PII is data that can be used to uniquely identify you, like your full name or home address. During your use of 2BLoved, you may be asked (but never required) to voluntarily provide PII, including but not limited to your name or home address. We will only ask for this if we believe it would help us to better serve you.

For community content on social media, 2BLoved’s owned and operated website or app; individuals automatically agree to the self-generated content they post or share. If 2BLoved deems this content violates the intentions of the organization, content will be removed.

Donors, who choose to give financially or provide services, to 2BLoved can choose to have their names and contact information listed or remain anonymous. All funds received by donation to 2BLoved will be used in the following way. 50% will be used to support and improve the infrastructure and resources of 2BLoved. 50% will be given to mental wellness professional or non-profit organizations as charitable contributions. At times, 2BLoved may raise funds to support individuals needing help paying for professional mental wellness services. 100% of those funds will be used to contribute towards that individual’s mental wellness costs. 2BLoved keeps a record of each donor’s giving history for IRS purposes, to analyze giving patterns, make budget projections, and solicit future donations. We do not share our donor file with any other party or organization.

To protect the privacy and safety of our staff and volunteers, you agree to not communicate with our staff and volunteers outside of the Services. If you have questions, comments or feedback for us, please email Support@2BLoved.org.

OPT-OUT / OPT-IN

2BLoved may send individual or group text messages and emails to subscribers and individuals that reach out to chat. If you no longer wish to receive messages or emails from 2BLoved, you may opt out at any time by texting the word “STOP”, or emailing the word “UnSubscribe”. You may opt back in anytime by texting or emailing the word “READY”.

RISKS

You assume all risk for interacting with 2BLoved. Neither 2BLoved nor any of our employees, volunteers, agents, service providers, or any other entities with whom 2BLoved has contracted shall have any liability for or in connection with (1) actions taken or not taken by you or a third party, during, after, or as a result of interacting with 2BLoved, or (2) the unavailability of 2BLoved. You agree to indemnify us and hold us harmless for damages arising out of (A) your interaction with 2BLoved, (B) your breach of these Terms, (C) your violation of the law, (D) claims asserted by third parties that you are in breach of these Terms or (E) information provided by you to 2BLoved. Additionally, in no event will 2BLoved be liable for any special, incidental, consequential, exemplary, or indirect damages.

2BLoved operates on an “as is” basis and “as available” basis. 2BLoved and its service providers expressly disclaim all warranties of any kind, whether express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. Without limiting the above, 2BLoved and its service providers make no warranty that 2BLoved will (A) meet your requirements; (B) be uninterrupted, timely, secure, or error-free; or (C) meet your expectations. The foregoing disclaimers of liability apply to all damages or injury, including those caused by any failure of performance, error, omission, interruption, deletion, defect or delay in operation or transmission, whether for breach of contract, tortious behavior, including negligence, or any other cause of action.

California Civil Code Section § 1798.83 permits users that are California residents and interacting with 2BLoved to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. As a not-for-profit organization filing to become exempt from federal income tax under Section 501(c)(3) of the Internal Revenue Code, 2BLoved will become exempt from compliance with the Children’s Online Privacy Protection Act of 1998. However, we take children’s privacy seriously, and encourage users and their parents to review our Terms to understand our information collection practices.

PROHIBITED USES; RIGHT TO TERMINATE ACCESS

You agree to use our Services only for lawful and legitimate purposes and in accordance with these Terms. You agree not to use the Services:

• in any way that violates any applicable federal, state, local, or international law or regulation;

• for the purpose of exploiting, harming, or attempting to exploit or harm minors in any way;

• to threaten, harass, or otherwise inappropriately abuse 2BLoved, its employees, partners, agents, contractors, volunteers, or others;

• to send, knowingly receive, upload, download, use, or re-use any content which does not comply with these Terms;

• to “spam,” gather or attempt to gather personal information belonging to users or others for the purposes of spamming, marketing, selling to third parties, or otherwise abusing 2BLoved, our Services, or our users;

• to impersonate or attempt to impersonate another person or entity;

• to engage in any other conduct that restricts or inhibits anyone’s use or enjoyment of the Services, or which, as determined by us, may harm 2BLoved or individuals who interact with 2BLoved, or expose them to liability;

• to copy, adapt, decompile, reverse engineer, attempt to discover the source code of or make derivative works of 2BLoved

• to otherwise attempt to interfere with the proper working of 2BLoved.

2BLoved reserves the right to terminate your access to our social media pages and owned and operated platforms if you violate these Terms, including doing anything on the list above. 2BLoved further reserves the right to terminate or adjust your access to them for any other reason, at our sole discretion or if we determine that you’d be better served by a different kind of support.
